Judge denies probation, sends man to prison
A man who broke into the Carter County Sheriff’s Department impound lot last year and stole a vehicle has been ordered to serve his eight-year sentence in a state prison.
Judge Jon Kerry Blackwood, substituting for Judge Robert Cupp, denied Edward Timbs’ request for probation on Wednesday in Carter County Criminal Court. As a result, Blackwood ordered the 57-year-old Elizabethton man to serve a total of eight years in the Tennessee Department of Correction.
Timbs pleaded guilty in May to fifth offense DUI, third offense driving on a revoked license, resisting arrest, theft over $500 and vandalism over $1,000. He was arrested in September by the Carter County Sheriff’s Department and Elizabethton Police Department. During his arrest, Timbs claimed he was beaten up by several officers. He later filed a complaint in U.S. District Court. The complaint is pending.
